Re: Regarding the question: Will you vote to eliminate the “by reason of insanity” defense?

We may be trying to change the way things are, but that doesn't mean we should ignore an issue just because most people may not want to talk about it.  The questions are not intended to establish a platform for the party, they are there to allow us to know how the candidates will vote if the issue appears.

The platform of GOOOH is about as general as you can get; Replace the politicians in office now with people who will represent the people who votes for them.  As far as I can tell, the Party does not take a stance on issues.

Why do we even care about this when we are trying to change our government.  WE need to be more general about the platform to attract a large base.  something like this can be debated later.

That seems fair.

The current wording seems decent to me.  If you want to change it, I believe that a better change might incorperate this:

Remove the Insanity defense.  Allow the defendant to plea Guilty by cause of Insanity, or something to that effect.   If the defendant could prove that he was not in control of his actions, similar to how it is now, the he or she would be placed in a mental institution until deemed mentally fit.  At which time, the defendant would be transfered to prision to serve the remaining sentence.  So if the term was set for 15 years, and it takes 5 years to treat the defendant, the remaining 10 years are spent in prison.

The main reason for this would be to remove those people who are mentally fit from the institution so that those who are in need of help can recieve the treatment they need.

Now that I think about it, we may want to change to "Will you vote to require that any person who uses the insanity defense must agree to be committed to a mental institution for the maximum allowable sentence for the crime committed?" My initial assumption was that insanity defense would only be used in cases of murder, but I suppose it could be used in other situations as well. Or better yet, what about this: "Will you vote to require that any person who uses the insanity defense must agree to be committed to a mental institution for life in the case of violent crimes, or the maximum allowable sentence for the crime committed for nonviolent crimes?" Boy, the plot thickens. Corey

I like the original wording. It is much less ambiguous. On a side note, I have to admit I feel like I am drilling you, but that is not my intent. I commend your ability to talk about this without getting defensive. It is almost uncanny.

An early proposal on this was, "Will you vote to require that any person who uses the insanity defense must agree to be committed to a mental institution for life?" What would you propose?

Regarding the question: Will you vote to eliminate the “by reason of insanity” defense?
I have no problem with someone going to a mental institution instead of prison if they are insane, as long as they are removed from the public and cannot harm anyone anymore. The idea of temporary insanity is ridiculous, and I do support getting rid of that, however it has not been successfully used in 50 years. I recognize that some of this is an exercise in clarity, but I am posting all of this stuff to: a) start a discussion b) help to make questions more airtight Feel free to delete any threads if I am being overly posty, but this forum seems underused and I am trying to fill 'er up.
